1. Acceptance of Terms

By accessing and using DialB's services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

2. Service Description

DialB provides advanced spam monitoring and protection services for Direct Inward Dialing (DID) numbers and business phone numbers. Our Services include:

  • Real-time monitoring of spam reputation across major carriers
  • Automated alerts for spam flagging incidents
  • API access for programmatic monitoring and management
  • Comprehensive reporting and analytics
  • Remediation guidance and support

3. User Responsibilities

As a user of our Services, you agree to:

  • Provide accurate and complete information during registration
  • Maintain the confidentiality of your account credentials
  • Use the Services only for lawful purposes and in accordance with these Terms
  • Not use the Services to monitor numbers you do not own or have explicit permission to monitor
  • Not attempt to circumvent any security measures or access restrictions
  • Promptly notify us of any unauthorized use of your account

4. Payment Terms

4.1. Subscription Fees: Services are provided on a subscription basis with fees based on the selected plan and number of DIDs monitored.

4.2. Billing: Subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable unless otherwise specified.

4.3. Automatic Renewal: Subscriptions automatically renew unless cancelled before the renewal date.

4.4. Price Changes: We reserve the right to modify pricing with 30 days advance notice. Continued use after price changes constitutes acceptance.

5. API Usage Terms

5.1. API Access: API access is provided according to your subscription plan with specific rate limits and usage quotas.

5.2. API Keys: You are responsible for maintaining the security of your API keys. Do not share API keys or embed them in publicly accessible code.

5.3. Usage Restrictions: You may not use the API to:

  • Exceed rate limits or circumvent usage restrictions
  • Create derivative works or competitive services
  • Resell or sublicense API access without written permission
  • Perform any actions that could harm or overload our infrastructure

6. Data and Privacy

6.1. Your use of our Services is also governed by our Privacy Policy.

6.2. You retain ownership of your data. We will not sell or share your data with third parties except as necessary to provide the Services or as required by law.

7. Limitation of Liability

7.1. Service Availability: While we strive for high availability, we do not guarantee uninterrupted or error-free service. The Services are provided "as is" and "as available."

7.2. Disclaimer: DialB provides monitoring and reporting services only. We are not responsible for:

  • Actions taken by carriers regarding spam flagging
  • Loss of business due to spam flagging
  • Accuracy of third-party spam databases
  • Results of remediation efforts

7.3. Liability Cap: Our total liability shall not exceed the amount paid by you for the Services in the twelve months preceding the claim.

8. Indemnification

You agree to indemnify and hold DialB harmless from any claims, damages, or expenses arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

9. Termination

9.1. By You: You may cancel your subscription at any time through your account dashboard or by contacting support.

9.2. By Us: We may suspend or terminate your access if you violate these Terms or engage in fraudulent or harmful activities.

9.3. Effect of Termination: Upon termination, your access to the Services will cease immediately. You may request data export within 30 days of termination.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or through the Services. Continued use after changes constitutes acceptance of the modified Terms.

11. General Provisions

11.1. Governing Law: These Terms are governed by the laws of the United States and the State of Delaware.

11.2. Dispute Resolution: Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.

11.3. Severability: If any provision is found unenforceable, the remaining provisions shall continue in effect.

11.4. Entire Agreement: These Terms constitute the entire agreement between you and DialB regarding the use of our Services.
